Terms and conditions

All orders imply the buyer's acceptance of our general conditions of sale.


DELIVERY TIME: Indicated on request when ordering, it is indicative. The period begins to run from the date of shipment. Any delay in delivery due to force majeure (delay of suppliers, strikes, attacks ... delay or loss of post) will not engage the responsibility of Grim'Art. Any order is deliverable as far as stocks are available and the deadlines for certain items depend on the availability of our craftsmen.

Sending in followed letter, registered letter or colissimo.

- For France, approximately 4 days.

- For Europe and Switzerland, around 4 to 10 days.

- For the rest of the world, around 5 to 14 days.


ARTICLES: Being made by hand, with a vegetable tanned leather and respecting the nature of the skin of each animal, each article is unique by its color, the grain of the leather or its small defects which give all its warmth and authenticity to the object and which cannot give rise to any claim. Personalized or made-to-measure items cannot be returned or exchanged and will not give rise to any refund (except error on our part).


DELIVERY: Delivery is deemed to have been made as soon as the product is made available to the customer. It is up to the recipient to check the shipments on arrival and to make all the reservations and justified complaints on the delivery slip or the double of the invoice. If applicable, they must be sent by registered letter to Grim’Art within two days of receipt of the goods.

Packages are sent to the shipping address indicated by the customer when ordering. In case of error on the part of the customer and return by post and only upon receipt of the package by Grim’Art, the customer will be reimbursed for his order less the shipping costs.


RETURN / RETRACTATION: If an article does not give you complete satisfaction, you can return it within fourteen days (14) following receipt in its original packaging, unused and in perfect condition, accompanied by a copy of the invoice. Frank your package because any postage due or cash on delivery will be refused.

Upon receipt of your package you must check the conformity of the goods at the time of delivery and confirm by acknowledgment of receipt these reservations to the carrier before three working days.

If the articles need to be returned to us, they must be the subject of a return request by email or by the contact form within 14 days of delivery.

After this period, any claim cannot be accepted.

If the opening of a postal inquiry was necessary (abnormal delivery time, undelivered parcel, etc.), the customer must notify Grim'Art as soon as possible and at the latest one (1) month from the expected delivery date of the package. After this period, no claim will be taken into account.

In case of return of your entire order, we will reimburse you for all of your expenses including the initial delivery costs.

Partial return of part of the items ordered will result in reimbursement of the item (s) but not delivery costs.

The reimbursement will be made on the same credit card as the payment.

We can defer reimbursement until we have received the goods.

Return costs are your sole responsibility.

Be sure to keep proof of shipment of your return, like a written declaration from a transport or postal service provider indicating the sender and recipient of your return, and justifying the actual shipmen of goods. If Grim’Art does not receive your return, we may ask you for proof of shipping.

- Your package is kept fot 10 to 15 days in your post office from the date of the postman's first visit. After this period, it will be return to Grim'Art. We try to send an email or telephone to the buyer or/and the recipient according the information we have to inform you if your package must be collected at the post office. However, if you do not go and collect it and at your request , we will cancel your order once the package has been collected by Grim'Art (you have 14 days). In this case , you will not be reimbursed for the initials shipping costs; indeed, the non withdrawal of the package does not result from the right of withdrawal (because you have not see or checked the ordered item) or the refusal (you have not noticed any damage to the packaging).

If you want to received it again, you have to reorder.


PRICES: The prices are inclusive of all taxes. The prices shown on our offers have no contractual value and are subject to change. 20% VAT. The prices can be different on the sites and in the shops.

Grim’Art is not required to check or inform its customers of any applicable customs duties and taxes for sales outside the European Union.

RETENTION OF TITLE: Grim’Art intends in all cases to invoke the retention of title clause until full payment for the goods delivered, in accordance with the provisions of the law.


RIGHTS AND FREEDOMS and GDPR: The information collected is subject to computer processing intended to process your order and send you newsletter or email. The recipient of the data is Grim'Art which does not transfer your data to any other company. In accordance with the law "IT and liberties" of January 6, 1978 modified in 2004, you have the right to access and modify information concerning you. These general conditions of sale are subject to French law.

In the event of a dispute over the interpretation, execution or validity of these general conditions of sale, the French courts will have sole jurisdiction.

In case of dispute, the text retained for the general conditions of sale will be that written in French, English being produced for information only.

LEGAL AND COMMERCIAL GUARANTEES

The legal guarantee of conformity

(Art. L. 211-1 to L. 211-4 of the Consumer Code)

The professional seller must deliver goods that conform to the contract. Failing this, he is responsible for faults during delivery, but also for all those resulting from packaging, assembly instructions or installation when he is responsible for the contract or under his responsibility (L211-4) .

Conformity of the property

A good is compliant, according to L211-5, when it is either

- suitable for the use usually expected of a similar good, if applicable, etc.:

            that it corresponds to the description of the seller and have the qualities presented in sample or model

            that it has the qualities that a consumer can legitimately expect following public declarations by the seller, producer or representative (advertising, labeling, etc.). The statements of these last two professionals do not bind the seller when the latter does not know them and is not in a legitimate position to know them.

- has the characteristics defined by the parties or be specific to the special purpose sought by the buyer, known to the seller and accepted.

Deadlines

The action to guarantee compliance is prescribed by 2 years from the delivery of the goods.

For goods purchased after March 18, 2016, all non-conformities appearing during the 2 years following the purchase, with the exception of second-hand goods whose period will be maintained at 6 months, are presumed to exist. This presumption operates a reversal of the burden of proof for the benefit of the consumer; it is up to the professional to prove that the defect did not exist.

Exceptions

The consumer cannot exercise the guarantee of conformity according to L.211-8 in three cases:

            when he was aware of the defect at the time of contracting

            when he could not ignore the defect when contracting

            when the defect results from materials which he himself supplied.

Implementation of the conformity guarantee

When there is a lack of conformity, the professional offers the consumer the replacement of the product or its repair. The choice depends on the consumer, except when this generates disproportionate costs for the professional compared to the second means.

The consumer can obtain the termination of the contract or its termination (reduction in the price of the goods) if the defect is major and the time limit for the solution chosen exceeds 1 month from the request; or that no way is achievable.

No costs can be charged to the consumer for replacement, repair, termination or termination of the contract.

The legal guarantee against hidden defects

(Art. 1641 to 1649 of the Civil Code)

The seller is bound by the guarantee for hidden defects in the thing sold which makes it unfit for the use for which it is intended, or which reduces such use so much, that the buyer would not have acquired it, or has not would have given a lesser price, if he had known them.

The legal guarantee covers all costs caused by hidden defects.

The professional is not liable for apparent defects of which the buyer was able to convince himself, but for hidden defects, even though he did not know them, unless, in this case, he stipulated that there will be no warranty.

The defect must be prior to the sale and make the products unfit for the use for which they are intended.

The buyer has the choice:

            return the thing and get the price returned

            keep the thing and get part of the price

The time to act is 2 years from the discovery of the defect.

It is the trial judges who sovereignly assess whether the thing sold is unsuitable for its destination. Examples:

            the impossibility in which the seller found himself to put the machine sold back into working order shows that the defect made the thing unfit for the use for which it was intended.

                        the attitude of the seller who, after two successive failures affecting the same part, agrees to replace it at his expense, establishes, in the absence of contrary elements, the existence of a hidden defect.

We would like to point out that in the event of a product return for lack of conformity, you must complete a declaration of non-conformity. Upon receipt of the product, a penalty of six (6) euros will be deducted from the reimbursement in the event of a defect on the stated reason.

Commercial warranty

Means any contractual commitment by a professional towards the consumer for the reimbursement of the purchase price, replacement of the item, in addition to its legal obligations to ensure the conformity of the good. Some items are subject to a commercial guarantee from the supplier. In this case, it will be specified on the product sheet of the product concerned. If no warranty is specified on the product sheet, then the product does not give rise to any warranty

GARANTIES LÉGALES ET COMMERCIALES

La garantie légale de conformité

(Art. L. 211-1 à L. 211-4 du Code de la consommation)

Le professionnel vendeur doit livrer un bien conforme au contrat. A défaut il est responsable des défauts lors de la délivrance, mais également de tout ceux résultant de l’emballage, des instructions de montage ou de l’installation lorsqu’elle est à la charge du contrat ou sous sa responsabilité (L211-4).

Conformité du bien

Un bien est conforme, selon L211-5, lorsqu’il est soit

- propre à l’usage habituellement attendu d’un bien similaire, le cas échéant, etc, :

            qu'il correspond à la description du vendeur et posséder les qualités présentées en échantillon ou modèle

            qu’il présente les qualités qu’un consommateur peut légitimement attendre suite aux déclarations publiques du vendeur, producteur ou représentant (publicité, étiquetage, etc,). Les déclarations de ces deux derniers professionnels ne lient pas le vendeur lorsque celui-ci ne les connaît pas et n’est pas en mesure légitime de les connaître.

- présente les caractéristiques définies par les parties ou être propre à l’usage spécial recherché par l’acheteur, connu du vendeur et accepté.

Délais

L’action en garantie de conformité se prescrit par 2 ans à compter de la délivrance du bien.

Pour les biens achetés après le 18 Mars 2016, tous les défauts de conformité apparaissant pendant les 2 ans suivant l’achat, à l’exception des biens d’occasion dont le délai sera maintenu à 6 mois, sont présumés exister. Cette présomption opère un renversement de la charge de la preuve au bénéfice du consommateur ; c’est au professionnel de prouver que le défaut n’existait pas.

Exceptions

Le consommateur ne peut pas faire jouer la garantie de conformité selon L.211-8 dans trois cas :

            lorsqu’il avait connaissance du défaut au moment de contracter

            lorsqu’il ne pouvait ignorer le défaut au moment de contracter

            lorsque le défaut résulte de matériaux qu’il a lui-même fournis.

Mise en œuvre de la garantie de conformité

Lorsqu’il y a défaut de conformité, le professionnel propose au consommateur le remplacement du bien ou sa réparation. Le choix dépend du consommateur, sauf lorsque celui-ci engendre pour le professionnel des coûts disproportionnés par rapport a second moyen.

Le consommateur peut obtenir la résolution du contrat ou sa réfaction (réduction du prix du bien) si le défaut est majeur et que le délai de la solution choisie excède 1 mois à partir de la demande ; ou qu’aucun moyen n’est réalisable.

Aucun frais ne peut être demandé au consommateur pour le remplacement, la réparation, la résolution ou la réfaction du contrat.

La garantie légale contre les vices cachés

(Art. 1641 à 1649 du Code civil)

Le vendeur est tenu de la garantie à raison des défauts cachés de la chose vendue qui la rendent impropre à l'usage auquel on la destine, ou qui diminuent tellement cet usage, que l'acheteur ne l'aurait pas acquise, ou n'en aurait donné qu'un moindre prix, s'il les avait connus.

La garantie légale couvre tous les frais entraînés par les vices cachés.

Le professionnel n'est pas tenu des vices apparents et dont l'acheteur a pu se convaincre lui-même, mais des vices cachés, quand même il ne les aurait pas connus, à moins que, dans ce cas, il n'ait stipulé qu'il ne sera obligé à aucune garantie.

Le défaut doit être antérieur à la vente et rendre les produits impropres à l'usage auquel ils sont destinés.

L'acheteur a le choix :

            rendre la chose et se faire restituer le prix

            garder la chose et se faire rendre une partie du prix

Le délai pour agir est de 2 ans à compter de la découverte du vice.

Ce sont les juges du fond qui apprécient souverainement si la chose vendue est impropre à sa destination.
Exemples :

            l'impossibilité dans laquelle s'est trouvé le vendeur de remettre en état de marche la machine vendue montre que le vice rendait la chose impropre à l'usage auquel elle était destinée.

                        l'attitude du vendeur qui, après deux pannes successives affectant la même pièce, accepte de la remplacer à ses frais, établit, en l'absence d'éléments contraires, l'existence d'un vice caché.

Nous tenons à vous préciser qu’en cas de retour de produit pour défaut de conformité, vous devez remplir une déclaration de non-conformité. A réception du produit, une pénalité de six (6) euros sera déduite du remboursement en cas de vice sur le motif déclaré.

Garantie commerciale

S’entend de tout engagement contractuel d’un professionnel à l’égard du consommateur en vue du remboursement du prix d’achat, du remplacement de l’article, en sus de ses obligations légales visant à garantir la conformité du bien. Certains articles font l’objet d’une garantie commerciale de la part du fournisseur. Dans ce cas, celle-ci sera spécifiée sur la fiche produit du produit concerné . Si aucune garantie n’est spécifiée sur la fiche produit, alors le produit ne donne lieu à aucune garantie commerciale.

GARANTIES LÉGALES ET COMMERCIALES

RETOUR : Si un article ne vous donne pas entière satisfaction, vous pouvez le retourner dans les quatorze (14) jours suivant réception dans son emballage d’origine, non utilisé et en parfait état, accompagné d’une copie de la facture. Affranchissez votre paquet car tout retour en port dû ou en contre-remboursement sera refusé.
